These Terms and Conditions (“Terms”) are a binding agreement between you (“you” or “your”) and The Temple of Tantra (“we”, “us”, or “our”) governing your use of thetempleoftantra.com (the “Website”) and any program, course, or service offered through it (together, the “Services”). By using the Website or purchasing a Service, you agree to these Terms and to our Privacy Policy, which is incorporated into them. If you do not agree, do not use the Website or Services. The version of these Terms in effect at the time of your purchase governs that purchase.
By using the Website or purchasing a Service, you accept these Terms. You must be at least 18 years old to use the Website or purchase any Service, and you represent and warrant that you are 18 or older. If you use the Website on behalf of an organization, you represent that you are authorized to bind it to these Terms. We may update these Terms at any time by posting a revised version, and your continued use after a change means you accept it. The version in effect when you purchase a Service governs that purchase.
Some Services require an account. You are responsible for keeping your login credentials confidential and for all activity under your account. Your access is personal to you. You may not share, sell, or transfer your account or login, and you may not let anyone else use it. We may suspend or terminate an account that violates these Terms or that is used in a way that could harm the Services or other users.
Prices for Services are shown at checkout. Payments are processed by our third-party payment processor. We do not receive or store your full payment card details. You agree to provide current, complete, and accurate payment information, and you authorize us and our processors to charge your chosen payment method for the amounts due.
Where a Service is offered on a payment plan, you authorize the scheduled installments. If a payment is declined or not made when due, we may suspend your access until the balance is current, and continued non-payment may result in termination of access. You remain responsible for the full amount you agreed to pay. We may correct pricing errors, and we may decline or cancel any order at our discretion, including where a transaction appears fraudulent or high risk.
All sales are final. Because our Services are digital and made available to you immediately, all purchases are non-refundable, and we do not offer returns, exchanges, or cancellations, except where a refund is required by applicable law or is expressly offered by us in writing. Any refund we choose to offer is at our sole discretion and does not create a right to any future refund.
If you believe there is a problem with a charge, contact us first and we will work with you. Because all sales are final, initiating a chargeback or payment dispute in breach of these Terms is itself a breach of this agreement. In that event, we may immediately terminate your access to all Services, decline to provide you Services in the future, and recover the costs we incur in responding, including reasonable administrative and legal fees, to the extent permitted by law.
The Website and all Services, including text, video, audio, graphics, logos, and course materials, are owned by The Temple of Tantra or its licensors and are protected by copyright, trademark, and other laws. The Temple of Tantra™ and related marks are our trademarks and may not be used without our written permission.
When you purchase a Service, we grant you a limited, personal, non-transferable, non-exclusive license to access and use the materials for your own personal, non-commercial use. You may not copy, record, reproduce, republish, share, resell, sublicense, distribute, publicly display, or teach the materials to others, except where we expressly provide a downloadable file or permit it in writing. Any file we make available to you remains our copyrighted property and is licensed to you for your own personal use only. You may not share your login or upload the materials to any file-sharing or other service. Sharing logins, reselling, or re-uploading our materials is copyright infringement, and we may pursue every remedy available to us. We may revoke your license and access if you breach this section.
Our programs are living products that we improve over time. We may add to, edit, replace, remove, reorder, or discontinue any part of a program or its content at any time, at our sole discretion and without notice. What you purchase is access to the program as it evolves, not to any specific video, module, or file. Where a program remains available to you, improvements we make are generally made available to enrolled participants.
Our course materials, frameworks, and non-public information are confidential and proprietary to us. You agree not to disclose, reproduce, distribute, or teach our materials to any third party, and to use them only for your own personal use. This obligation applies to anyone who receives our materials, including where they were received for free, and it continues after your access ends. Information we have made public is not covered by this section.
Our Services are for educational and self-development purposes only. They are not medical, psychological, psychiatric, therapeutic, financial, or legal advice, and they are not a substitute for care from a qualified professional. We are not medical or mental-health providers, and nothing in our Services diagnoses, treats, or cures any physical or mental condition. You agree to indemnify and hold harmless The Temple of Tantra and its owners, employees, and agents from any claims, losses, liabilities, and expenses, including reasonable legal fees, arising out of your use of the Website or Services, your content, or your breach of these Terms.
You also release us from any claims you do not know or suspect to exist at the time of your use of the Website or Services, and you waive the benefit of any law that would otherwise preserve such unknown claims.
We may suspend or terminate your access to the Website or any Service at any time if you breach these Terms, misuse the Services, or engage in abusive, threatening, or defamatory conduct toward us or others. This does not restrict honest reviews. On termination for breach, your access and permission to use the materials end, no refund is due, and any remaining balance on a payment plan remains payable. The sections that by their nature should survive termination will survive, including intellectual property, confidentiality, disclaimers, limitation of liability, indemnification, and dispute resolution.
If a dispute arises, both parties agree to first try to resolve it informally before taking any further action. Any dispute that cannot be resolved informally will be resolved by binding individual arbitration rather than in court, except as stated below.
You and The Temple of Tantra waive the right to a jury trial, and you agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any class or representative action.
This section does not prevent either party from bringing an individual claim in small-claims court, and it does not prevent us from seeking an injunction or other equitable relief in court to protect our intellectual property or confidential information. These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules, and the exclusive venue for any matter not subject to arbitration is the state or federal courts located in Palm Beach County, Florida. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
You agree to bring any legal claim or lawsuit relating to the Website or Services within one year after it arises. Any claim brought after that is permanently barred, to the extent permitted by law.
If any provision of these Terms is held unenforceable, the rest remain in effect, and the provision is modified only as far as needed to make it enforceable. These Terms do not create any right or benefit for any third party. You may not assign these Terms without our consent, and we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for any delay or failure caused by events beyond our reasonable control. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Website and Services, and supersede any prior understanding. Our failure to enforce a provision is not a waiver of it. You consent to receive communications from us electronically, and you agree that electronic agreements and notices satisfy any legal requirement that they be in writing.
